In addition, DPAs have sweeping powers to demand evidence of GDPR compliance, and that can include “show-me-your-DPIA” requests. With all the AI doomsaying by tech giants using their superintelligence to (checks notes) write letters warning of extinction risks □♀️, it seems prior consultation is warranted. Prior consultation with the relevant DPA is required if residual risk remains high. Now, Ireland has pumped the breaks because Google hasn’t provided evidence of a Data Protection Impact Assessment (DPIA).Ī DPIA is ‼️mandatory ‼️where processing is likely to result in a high risk to the rights and freedoms of individuals, esp. We already saw Italy’s Garante put a pause on OpenAI’s #chatgpt. As #Google has learned with #Bard, this can delay market entry. Nor are they waiting for harms to manifest before they act.ĭPAs in the #EU are proactively reaching into the #GDPR toolbox to take early & even pre-emptive action. Hey AI developers & purchasers!
